Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the aaloo.ai website, mobile applications, and related services (collectively, the “Services”). The Services are operated by Kokumi Technologies Private Limited (“Kokumi,” “aaloo.ai,” “we,” “us,” or “our”).

By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Who We Are and What We Provide

aaloo.ai provides a consumer platform that may include: meal logging, taste and preference profiling, food discovery, community discussions, direct messaging (DMs), user-generated content (photos/reviews/comments), gamified challenges, points and redemptions, paid subscriptions, cash prizes/contest campaigns, and brand partnership activations.

We may add, modify, or discontinue any part of the Services at any time, subject to applicable law.

2) Eligibility and Age Requirements

You must be legally capable of forming a binding contract to use the Services.

Minimum age: The Services are not intended for children under 13.

If you are 13–17, you may use the Services only with consent and supervision of a parent/guardian where required by law.

If we learn we have collected personal data from a child in a way not permitted by law, we may delete such data and restrict or terminate the account.

3) Account Registration, Security, and Communications

3.1 Account information: You agree to provide accurate information and keep it updated. You may be required to verify your phone number/email and complete additional verification for prizes or redemptions.

3.2 Account security: You are responsible for safeguarding your login credentials and all activity on your account. Notify us immediately of suspected unauthorized access.

3.3 Service communications: You consent to receive service-related communications (e.g., security, receipts, policy updates). Marketing communications (if any) will be provided with opt-out options where required by law.

4) Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy (incorporated by reference). We will handle personal data in accordance with applicable law, including India’s Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025, which were notified in November 2025.

If there is a conflict between these Terms and the Privacy Policy on privacy matters, the Privacy Policy controls.

5) Your License to Use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use, unless we expressly authorize otherwise in writing.

6) Acceptable Use and Prohibited Conduct

You agree not to:

Violate any law, regulation, or third-party rights (privacy, publicity, IP, consumer protection, etc.).

Post or share unlawful, harmful, hateful, harassing, sexually exploitative, or violent content.

Engage in doxxing, stalking, threats, impersonation, scams, fraud, or deceptive practices.

Send spam, bulk unsolicited messages, or run pyramid/referral schemes without written permission.

Upload malware, attempt to exploit vulnerabilities, or interfere with the Services.

Scrape, harvest, or systematically extract data from the Services except where permitted by law or with written authorization.

Reverse engineer, decompile, or attempt to discover source code except to the extent expressly permitted by law.

We may investigate violations and take action, including removing content, restricting features (including DMs), suspending, or terminating accounts.

7) User Content (Photos, Reviews, Posts, Messages)

“User Content” means content you submit or make available through the Services (including text, photos, ratings, comments, profile content, and messages).

7.1 You are responsible for your User Content: You represent and warrant that you own the User Content or have the necessary rights/permissions to post it; your User Content does not infringe third-party rights or violate law; and your User Content is not misleading, defamatory, or otherwise unlawful.

7.2 License you grant to us: You grant us a worldwide, royalty-free, sublicensable, transferable license to host, store, use, reproduce, modify (for formatting/display), create derivative works (e.g., thumbnails), display, distribute, and otherwise exploit your User Content to operate, improve, secure, and promote the Services (including featuring content in leaderboards, campaigns, and brand partnership pages).

7.3 Content visibility and deletion: You can delete User Content where the Services allow. However: Copies may persist in backups for a limited time; and if you shared User Content with others, it may remain visible if they re-shared or saved it (subject to applicable law and our controls).

7.4 DMs and safety: Direct messaging is provided for community interaction. You agree not to use DMs for harassment, solicitation, scams, or unlawful activity. We may apply rate limits, scanning for abuse signals, reporting tools, and enforcement measures consistent with law.

8) Moderation, Notice-and-Action, and Grievance Redressal

We may (but are not obligated to) monitor, remove, restrict, or disable access to content or accounts to enforce these Terms, comply with legal orders, or protect users and the Services.

We maintain a grievance redressal mechanism consistent with applicable Indian platform obligations, including grievance handling concepts reflected in India’s IT intermediary rules framework.

9) Intellectual Property

The Services (including software, design, UI/UX, logos, and proprietary features) are owned by us or our licensors and protected by IP laws. Except for the limited license in Section 5, no rights are granted to you.

You may not use our trademarks, branding, or copyrighted materials without written permission.

10) Subscriptions, Paid Features, and Billing

We may offer paid subscriptions and paid features (“Paid Services”).

10.1 Billing and authorization: By purchasing Paid Services, you authorize us (and our payment processors/app stores) to charge the applicable fees, taxes, and recurring charges (if any).

10.2 Auto-renewal: Unless otherwise stated at checkout, subscriptions renew automatically until cancelled. Cancellation becomes effective at the end of the current billing period (subject to app store rules where applicable).

10.3 Trials and promotional pricing: Trials and promotional pricing may convert to paid subscriptions unless cancelled before the trial ends. Trial eligibility is determined by us and may vary.

10.4 Refunds: Refund eligibility depends on the offer shown at purchase, your jurisdiction, and (if purchased via app stores) the app store’s policies. Unless required by law or expressly stated, fees are non-refundable once a billing period begins.

10.5 Price changes: We may change prices with prior notice as required by law. Continued use after the new price takes effect constitutes acceptance, subject to cancellation rights.

11) Points, Redemptions, Digital Items, and Wallet-Like Balances

We may provide points, badges, credits, coupons, digital items, and redemption mechanisms (“Rewards”).

Rewards are generally not legal tender, have no cash value unless explicitly stated, and are not transferable except as we permit.

We may adjust, suspend, or discontinue Rewards programs, including correcting errors, preventing abuse, or responding to suspected fraud.

We may void Rewards earned through prohibited conduct, exploitation, or manipulation of the Services.

Important: Redemption availability may depend on geography, stock/partner availability, identity verification, and compliance checks.

12) Contests, Cash Prizes, and Brand Partnerships

We may run contests/challenges that include cash prizes, coupons, or partner benefits, sometimes in collaboration with brands (“Promotions”).

12.1 Promotion rules govern: Each Promotion will have separate rules (“Promotion Rules”) describing eligibility, entry period, selection criteria, prizes, and sponsor details. Promotion Rules are incorporated by reference and control for that Promotion.

12.2 Eligibility, verification, and disqualification: We may require identity/age verification and additional documentation (including KYC-like checks) for winners. We may disqualify entries for suspected fraud, multiple accounts, automation, collusion, or rule violations.

12.3 Taxes and withholding: Prizes may be subject to tax reporting and withholding. Where applicable, we may deduct or withhold taxes (including TDS) before awarding prizes, and/or require winners to provide tax details. India’s income tax framework includes TDS on net winnings under section 194BA with official guidance (May 2023 circular).

12.4 Publicity: Where permitted by law, winners may be asked to participate in reasonable publicity (e.g., username display, winner announcement) as described in the Promotion Rules. Where consent is required, we will request it.

12.5 Brand partners: Partner offers are provided by third parties; partner terms may apply. We do not guarantee partner fulfillment, quality, or availability, and partner disputes may need to be resolved with the partner (unless required otherwise by law).

13) Food, Health, and Medical Disclaimer (Healthcare Features)

The Services may include content related to food, nutrition, allergies, health, or wellness (including AI-generated recommendations or summaries). These are for informational purposes only and are not medical advice.

Do not use the Services to diagnose, treat, cure, or prevent any disease.

Do not rely on the Services for emergency situations. Seek immediate medical help when needed.

Always consult qualified healthcare professionals for medical decisions, allergies, dietary restrictions, and medication interactions.

You are solely responsible for your choices and outcomes.

14) AI/ML Features and Output Limitations

Where the Services use AI/ML: Outputs are probabilistic and may be incomplete, inaccurate, or not personalized to medical needs; we do not guarantee correctness, suitability, or outcomes; you should independently verify information before acting on it.

15) Third-Party Services and App Stores

The Services may integrate third-party services (payments, maps, analytics, social logins, cloud hosting, etc.). Your use of third-party services is governed by their terms and privacy policies. We are not responsible for third-party services.

If you download the app from an app store, the app store’s terms also apply.

16) Suspension and Termination

You may stop using the Services at any time.

We may suspend or terminate your access (or restrict features like posting/DMs) if we reasonably believe you violated these Terms or Promotion Rules, create risk or legal exposure for us or other users, engage in fraud or abusive behavior, or require restriction to comply with law or orders.

Upon termination, your license ends and we may delete or retain data as described in the Privacy Policy and required by law.

17) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free.

Some jurisdictions do not allow certain disclaimers, so portions may not apply to you.

18) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION.

19) Indemnity

You agree to defend, indemnify, and hold harmless Kokumi and its directors, officers, employees, agents, and partners from claims, liabilities, damages, losses, and expenses (including legal fees) arising from: your use of the Services; your User Content; your violation of these Terms, Promotion Rules, or applicable law.

20) Consumer Disclosures (India)

Where applicable, we will provide disclosures consistent with India’s consumer e-commerce framework.

21) Governing Law and Jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

You agree that courts located in New Delhi will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, subject to any mandatory consumer protections that apply to you.

22) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or by other reasonable means. Continued use after the effective date of updated Terms constitutes acceptance, except where prohibited by law.
